Abstract
This article examines, in the light of Barclays Bank Plc v Kufner, the vexed question of whether the Unfair Terms in Consumer Contracts Regulations 1999 cover surety transactions. The authors also urge caution—given the poly-contextual nature of surety transactions—in relation to any EU harmonisation of this area.
